By accessing and using Skoolar ("Service"), you accept and agree to be bound by the terms and provision of this agreement. Additionally, when using the Service, you shall be subject to any posted guidelines or rules applicable to such services.

                Important: If you do not agree to these Terms of Service, you should not use our Service.
            

2. Description of Service

Skoolar is a comprehensive school management platform that provides:

Student information management
Attendance tracking and reporting
Grade management and transcripts
Financial management and fee collection
Parent and teacher portals
Resource management and distribution
Blog and announcement features

We reserve the right to modify or discontinue the Service at any time without notice.

3. User Accounts and Registration

To access certain features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Keep your password secure and confidential
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

Note: Users under 18 years of age must have parental or guardian permission to use this Service.

6. Payment Terms

For paid subscriptions:

Billing: Subscription fees are billed in advance on a monthly or annual basis
Refunds: We offer a 14-day money-back guarantee for new subscriptions
Cancellation: You may cancel your subscription at any time from your account settings
Price Changes: We reserve the right to modify subscription prices with 30 days' notice
Payment Failure: Failure to pay may result in service suspension

7. Data Ownership and Backups

You own all data you input into the Service. We will:

Maintain regular backups of your data
Provide data export capabilities
Delete your data upon account termination within 30 days

                Recommendation: Regularly export your data as a backup. We are not responsible for data loss due to user error or account termination.
            

8. Limitation of Liability

IN NO EVENT SHALL MY SCHOOL SYSTEM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. MY SCHOOL SYSTEM MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

10. Indemnification

You agree to indemnify, defend, and hold harmless Skoolar and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way related to:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Your content uploaded to the Service

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Skoolar operates, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Dispute Resolution

Any disputes arising from these Terms shall be resolved through:

Negotiation: Parties will first attempt to resolve disputes through good-faith negotiations
Mediation: If negotiation fails, disputes will be submitted to mediation
Arbitration: Final resolution through binding arbitration if mediation fails

You may also bring claims in small claims court where applicable.

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination:

Your right to use the Service will immediately cease
You may lose access to your data
Provisions that should survive termination will remain in effect

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

Posting the updated Terms on our website
Sending an email notification
Displaying a notice in the Service

Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
